สมาคมการค้าผู้ประกอบธุรกิจบันเทิงไทย

  สมาคมการค้าผู้ประกอบธุรกิจบันเทิงไทย “THAI ENTERTAINMENT CONTENT TRADE ASSOCIATION” หรือ TECA ได้เกิดจากการรวมตัวกันระหว่างบริษัทที่ประกอบกิจการเกี่ยวกับธุรกิจบันเทิงของไทยและต่างประเทศ เริ่มดำเนินงานเมื่อเดือนพฤศจิกายน 2545 โดยมีสมาชิกขณะนี้ 12 บริษัท ประกอบด้วย

 บทบาทของสมาคมการค้าผู้ประกอบธุรกิจบันเทิงไทย
ความสำเร็จของอุตสาหกรรมบันเทิงขึ้นอยู่กับความสามารถในการลงทุนและการพัฒนาสร้างสรรค์สิ่งใหม่ๆ เพื่อให้ได้รับผลตอบแทนที่คุ้มค่า บทบาทของสมาคมฯ คือการสร้างความเชื่อมั่นแก่อุตสาหกรรมบันเทิงทุกแขนงให้ตระหนักถึงศักยภาพของตนที่มีอยู่ ดังนั้นสมาคมฯ จึงดำเนินกิจกรรมเพื่อสนองตอบความสำเร็จของมวลสมาชิกนั่นเอง ซึ่งกิจกรรมเหล่านั้นได้แก่

 - สนับสนุนและส่งเสริมกฎหมายภายในประเทศและระหว่างประเทศเพื่อให้มีการคุ้มครองสิทธิในทรัพย์สินทางปัญญา
สมาคมฯ จะรณรงค์ให้มีการคุ้มครองสิทธิของสมาชิกในเวทีระดับประเทศ และระหว่างประเทศ เนื่องจากการพัฒนาทางเทคโนโลยีระบบดิจิตอล ทำให้สังคมโลกเกิดสภาวะไร้พรมแดน ดังนั้น บทบาทในการให้ความคุ้มครองสิทธิจึงมีความสำคัญและจำเป็นอย่างยิ่งสมาคมฯ สนับสนุนการบังคับใช้กฎหมายที่เกี่ยวกับลิขสิทธิ์และสิทธิข้างเคียงทั้งในระดับประเทศจนถึงระหว่างประเทศ ทั้งนี้เพื่อเป็นการให้ความคุ้มครองสิทธิของสมาชิก นอกจากนี้สมาคมฯ ยังเป็นตัวแทนของสมาชิกในการร้องเรียนเพื่อรักษาผลประโยชน์และร่วมเจรจาในการดำเนินการทางนิติบัญญัติด้วย

 - ต่อต้านการละเมิดทรัพย์สินทางปัญญา
การละเมิดทรัพย์สินทางปัญญาเป็นอาชญากรรมที่ร้ายแรงที่สุดของอุตสาหกรรมบันเทิง โดยในแต่ละปีจะสร้างความเสียหายต่อธุรกิจเป็นมูลค่าหลายพันล้านบาท ดังนั้น สมาคมฯ จะเข้าร่วมในกิจการต่อต้านการละเมิดลิขสิทธิ์ และสิทธิในทรัพย์สินทางปัญญาอื่นๆ ของอุตสาหกรรมบันเทิง โดยดำเนินการร่วมกับภาครัฐเพื่อให้มาตรการคุ้มครองทางกฎหมายที่เพียงพอและมีการบังคับใช้ที่มีประสิทธิภาพ นอกจากนี้ สมาคมฯ ยังมีบทบาทที่สำคัญในการทำการสืบสวนร่วมกับเจ้าหน้าที่รัฐเพื่อค้นและยึดสิ่งผิดกฎหมายที่ละเมิดทรัพย์สินทางปัญญาของอุตสาหกรรมบันเทิง รวมทั้งเครื่องมือเครื่องใช้ในการผลิตสิ่งทีผิดกฎหมายเหล่านั้นด้วย นอกจากที่ได้กล่าวมาแล้ว สมาคมฯ จะดำเนินการเตรียมข้อมูลเพื่อให้มีการฟ้องร้องดำเนินคดีต่อผู้กระทำความผิดด้วย

 - ให้ความเป็นอิสระแก่สมาชิก

สมาชิกสามารถดำเนินธุรกิจของตนไปได้โดยไม่ต้องกังวลเกี่ยวกับการดำเนินการปราบปรามผู้กระทำละเมิด เพราะสมาคมฯ จะดำเนินการต่อต้านการละเมิดทรัพย์สินทางปัญญาแก่สมาชิก

 - แสวงหาเทคโนโลยีใหม่ๆ
สมาคมการค้าผู้ประกอบธุรกิจบันเทิงไทย ได้ร่วมในการคิดค้นพัฒนาวิทยาการสมัยใหม่เพื่อแก้ไขปัญหาการละเมิดทรัพย์สินทางปัญญาของอุตสาหกรรมบันเทิง โดยเฉพาะอย่างยิ่ง พัฒนาการทางด้านอินเตอร์เน็ต และการผลิตสิ่งบันทึกเสียงในรูปแบบ Digital และ Analog เพื่อป้องกันการทำละเมิด

 -จัดหาข้อมูลข่าวสาร
สมาคมการค้าผู้ประกอบธุรกิจบันเทิงไทยจัดหาข้อมูลข่าวสารและวิเคราะห์ข้อมูลสถิติต่างๆ ในอุตสาหกรรมบันเทิงทั่วโลก เช่น สถิติการจำหน่าย, สถิติการละเมิด, มูลค่าของตลาด, รายงานสภาพการตลาดอุตสาหกรรมบันเทิงทั้งของไทยและต่างประเทศ, ข้อมูลวิชาการ ตลอดถึงรายงานความคืบหน้าในประเด็นข้อกฎหมายที่เกี่ยวข้องกับทรัพย์สินทางปัญญาและสิทธิข้างเคียง นอกจากนี้สมาคมฯ ยังเผยแพร่ข้อมูลเกี่ยวกับการพัฒนาการของอุตสาหกรรมบันเทิงด้านต่างๆ ให้สื่อมวลชนได้รับทราบอีกด้วย

 - สร้างระบบเครือข่าย
สมาคมการค้าผู้ประกอบธุรกิจบันเทิงไทยเป็นสมาชิกของ AMIA หรือ ASEAN Music Industry Association ซึ่งเป็นองค์กรอิสระของกลุ่มประเทศอาเซียนที่มีบทบาทในเวทีของอาเซียนและเป็นสมาชิกระดับ National Group ของ IFPI (The International Federation of the Phonographic Industry) ซึ่งเป็นสมาพันธ์ผู้ผลิตสิ่งบันทึกเสียงระหว่างประเทศซึ่งมีสมาชิกกว่า 1,400 บริษัทจากกว่า 75 ประเทศ (90%) ทั่วโลก ในการแลกเปลี่ยนข้อมูลระหว่างกัน และเป็นการเปิดช่องให้มีการร่วมลงทุนระหว่างกันอีกด้วย

 - ดำเนินการป้องปรามการละเมิดทรัพย์สินทางปัญญา
สมาคมการค้าผู้ประกอบธุรกิจบันเทิงไทยจะดำเนินการป้องปรามการละเมิดทรัพย์สินทางปัญญาโดยมุ่งเน้นให้การศึกษาแก่ประชาชนและบุคคลทั่วไป ตลอดจนนักเรียนนักศึกษา หรือผู้ประกอบการที่ประสงค์จะนำงานอันมีลิขสิทธิ์ ที่เกี่ยวกับอุตสาหกรรมบันเทิงไปใช้ในกิจกรรมของตน ให้มีความรู้และความเข้าใจที่ถูกต้องเกี่ยวกับสิทธิในทรัพย์สินทางปัญญา การคุ้มครองสิทธิ์และการบังคับใช้สิทธิทางกฎหมาย รวมทั้งไม่สนับสนุนสิ่งที่ละเมิดลิขสิทธิ์ที่ผิดกฎหมายไปพร้อมกัน เช่น การจัดสัมมนา, จัดนิทรรศการ หรือการตีพิมพ์เผยแพร่เอกสารและประชาสัมพันธ์ รวมทั้งให้การสนับสนุนแก่การจัดกิจกรรมดังกล่าวทั้งโดยหน่วยงานของรัฐและเอกชน เพื่อเพิ่มประสิทธิภาพการดำเนินงานนอกเหนือไปจากการปราบปรามด้วยอีกทางหนึ่ง

 - พัฒนาศักยภาพของอุตสาหกรรมบันเทิงในประเทศ
การสร้างเครือข่ายและการเชื่อมโยงติดต่อกับอุตสาหกรรมบันเทิงแขนงต่างๆ ทั้งในและต่างประเทศจะเป็นหนทางหนึ่งที่น่าจะทำให้เกิดผลดีต่ออุตสาหกรรมบันเทิงของไทย นอกจากจะทำให้เกิดการเรียนรู้เพื่อพัฒนาขีดความสามารถให้ทัดเทียมและก้าวไปสู่ความเป็นสากลได้แล้ว ยังเป็นการส่งเสริมและแลกเปลี่ยนวัฒนธรรมระหว่างกันได้เป็นอย่างดี
สมาคมฯ จะดำเนินการประสานงานและติดต่อกับอุตสาหกรรมบันเทิงของประเทศอื่นๆ เพื่อให้เกิดการติดต่อแลกเปลี่ยนวัฒนธรรมระหว่างกัน นอกจากนี้ สมาคมฯ จะจัดให้มีกิจกรรมเพื่อส่งเสริมวงการอุตสาหกรรมบันเทิงในประเทศไทย

  Thai Entertainment Content Trade Association or TECA was established by a formation of Thai and foreign entertainment companies. TECA starts its operations on November 2002 and, currently, consists of  12  members:

Roles of TECA

     The success of entertainment industry inevitably relies on investment abilities and development of new innovations to enhance significant returns. TECA, therefore, plays a prominent role in strengthening confidence of every area of entertainment industry in its business potential. As a result, TECA has carried out plenty of activities to support members’ achievements as described below.

-  Promotion and encouragement for local and international enforcement of copyright protection

     TECA has extremely campaigned for protecting rights of members both in national and international spheres. The rapid development of digital technologies makes the world borderless; so TECA’s role in the protection of rights is gradually important and crucial.
TECA has encouraged the enforcement of law, both in the national and international levels, on intellectual property right and neighboring right in order to protect rights of any and all members. Besides, TECA has also represented its members to make claims for their due interest and to make negotiations in legislation process.

-  Protests against Intellectual Property Infringement

     The intellectual Property infringement deems the harshest crime in the entertainment industry. Each year, this crime causes damage costs in the industry for several billions of baht. Therefore, TECA has always involved in all activities counteracting the infringement of copyright and other intellectual properties belonged to the entertainment industry. TECA has given good cooperation to related government bodies to enhance efficient and adequate legal protection and enforcement. TECA has also played the important role in carrying out investigations, together with competent officials, to seize and forfeit illegal products as well as tools and equipments used in producing such illegal products violating the intellectual property of entertainment industry. Except mentioned earlier, TECA has prepared related information for the prosecution against infringers

-  Offering of autonomy to members

     TECA enables its members to operate their businesses without any concerns about suppression to infringers because TECA will represent its members to make protests against the infringement of intellectual property.

-  Seeking for new technologies

     TECA has involved in creating and developing new technologies adopted to resolve the intellectual property infringement in the entertainment industry, especially Internet development and the production of sound recording in form of digital and analog to prevent possible infringements.

-  Providing related information

     TECA has provided to all members the information and statistical analysis associated with the entertainment industry such as statistics on distribution, infringement, market value, entertainment market conditions of Thailand and other countries, technical information, progress on laws relating to intellectual property and neighboring right. Furthermore,
TECA has regularly publicized to the mass media the development of Thai entertainment industry.

-  Formation of  network system

     TECA is a member of AMIA or the ASEAN Music Industry Association that is an independent organization of ASEAN, which takes roles in ASEAN forum and is a member in the National Group of IFPI (The International Federation of the Phonographic Industry) that is an international sound recording organization with 1,400 member companies from 75 countries (90%) worldwide. Under this network system, useful information has been regularly shared, and this gives a channel of joint investment between members.

-  Restraints on intellectual property infringement

     TECA has carried out restraints on intellectual property infringement by educating Thai people as well as students or entrepreneurs utilizing any copyrighted work relating to the entertainment industry for their activities so that these people have good knowledge and understanding about rights in the intellectual property, protection of right and enforcement; meanwhile, Thai people are aware that activities or products violating the copyright are not supported. The campaign activities include arrangements of seminar and exhibition, distribution of publicizing documents and supports to those activities arranged by government agencies and private organizations in order to intensify TECA’s operating efficacy apart from suppression activities.

-  Broadening the potential of national entertainment  industry

     Networking and connecting national and international entertainment industries together enhance advantages to Thai entertainment industry; they not only led to learning to develop local competitiveness to meet the international standard, they also vastly promote the cultural sharing.

     TECA has coordinated and contacted with the entertainment industry of other countries to share different cultures. Eventually, TECA shall continue arranging activities to promote Thailand’s entertainment industry.
